Supreme Court favors pharma

We at RxRights are disheartened at the recent Supreme Court ruling in favor of Big Pharma and against the poor.

Back in January, we told you how big pharmaceutical companies were being sued for overcharging hospitals and clinics designed to help the less fortunate for prescription drugs—despite negotiated caps on prices.

We commend Santa Clara and Santa Cruz counties in California for attempting to stand up to this injustice by taking the case all the way to the Supreme Court.

Unfortunately, the Court ruled that the counties had no right to bring such a lawsuit and that this responsibility falls to the Federal Government—in this case specifically the Department of Health and Human Services. But what the court failed to answer is who protects the counties from financial abuse when the appropriate federal agency refuses to act.
